It appears that the learned counsel representing the petitioner in the court below refused to take notice on behalf of the petitioner, so the notice was issued to the deponent and a report has been received that no such person named as Surendra Sao is residing in village Makhdumpur.
Perusal of the records of Cr. Misc. No.43911 of 2013 shows that prayer for bail of the petitioner was rejected by another Bench of this Court vide order dated 21.10.2013 giving liberty to renew prayer for bail after one year and again the petitioner filed this application for granting bail after suppressing
Patna High Court Cr.Misc. No.24908 of 2014 (6) dt.18-03-2015 the fact that he has earlier moved before this Court for grant of regular bail and he was admitted to bail vide order dated 18.6.2014 by this Court. Apparently, the petitioner has got bail vide order dated 18.6.2014 by playing fraud with this Court In view of the aforesaid facts, bail granted to the petitioner vide order dated 18.6.2014 in Spl. Case No. 44 of 2013 arising out of Pandarak P.S. Case No. 92 of 2013 is hereby cancelled and the court of learned Additional Sessions Judge XI, Patna is directed to issue warrant of arrest and processes against the petitioner through the Superintendent of Police for immediate execution.
