Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B),34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death.

Submission is that the witnesses have stated before the police that the victim sustained head injury while she was taking water from the hand-pump and as a result whereof, she died. The postmortem report would also reveal that head injury was cause of death. Further submission is that the victim was suffering from anemia during pregnancy which would be evident from the pathological report and prescription of the Doctor produced. Petitioner is in custody since 12.08.2018.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajoun Police Station Case No.346 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
