The petitioner is languishing in jail since 18.04.2015 in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, it is a case an attempt of murder and also theft of Rs.15,700/- from the pocket of the informant along with some ornaments of the informant by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.04.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal
Patna High Court Cr.Misc. No.40307 of 2015 (3) dt.30-10-2015 antecedent. There is no allegation of tampering of evidence against the petitioner. Petitioner has falsely been implicated in the present case due to village politics. There is admitted land dispute between the parties. It is a case and counter case. The other coaccused have been granted bail by this Court vide Cr.Misc.No.46353 of 2015 and Cr.Misc.No.43085 of 2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Maharajganj P.S.Case No.329 of 2014.
