====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 28-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.639(C) of 2015 registered under Section 498(A) of the Indian Penal Code besides Section 4 of the Dowry Prohibition Act.

The accusation is of torturing and causing assault to the complainant/opposite party no.2 by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and also removing the complainant/opposite party no.2 from the matrimonial house by snatching her personal belongings.

Patna High Court Cr.Misc. No.9031 of 2017 (6) dt.28-08-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that while the petitioner is ready to keep his wife (the complainant/opposite party no.2) but in spite of service of notice upon her under ordinary process, which was received by her father, she did not turn up.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Complaint Case No.639(C) of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
