The petitioner seeks bail in Lalganj P.S. Case No. 371 of 2020, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. On secret information that accused persons named in the FIR are engaged in manufacturing liquor, a raid was conducted and 880 litres of spirit has been recovered. Petitioner is said to have fled away after seeing the police party from the place of recovery.

It is submitted that no recovery has been made from conscious possession of this petitioner and he was not apprehended on the spot. Petitioner has got no concern with the seized spirit. Petitioner is in custody since 18.11.2021 having

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Exclusive Special Excise Court No. 1-cum-Additional District & Sessions Judge, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 371 of 2020.
