The petitioner is in custody in a case registered under Sections 25(1-B)A, 26(ii) of Arms Act.

It is alleged by the informant, Officer Incharge of Belsand Police Station, that on search one loaded rifle, knife and a mobile were recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.05.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. As per prosecution, there is recovery of one loaded country made rifle from the possession of the petitioner. It is further submitted that the alleged recovery is

Patna High Court Cr.Misc. No.38612 of 2015 (3) dt.08-10-2015 2/2 denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prasant Kumar Jha, learned J.M., 1st Class,Sitamarhi in Belsand P.S.Case No. 52 of 2015.
