JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-10-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel for the informant.

The petitioner is in custody in connection with Sigori P.S. Case No. 70 of 2019 for the offence under Sections 302, 201 and 120B of the Indian Penal Code.

In this case, case diary was called for.

From the materials available on record it appears that the petitioner has been made accused on suspicion that deceased was a person who used to visit the wife of the petitioner who is said to be a woman of easy virtue and for this reason, the deceased was eliminated in a planned manner. It is alleged that the petitioner was last seen with the deceased on 28.07.2019. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.5755 of 2020(5) dt.12-10-2020 2/2 submits that until decomposed dead body was recovered, no first information report was made before the police about missing of the deceased. On recovery, dead body was sent for post mortem. There is definite opinion of the doctor during post mortem of the deceased, that time elapsed since death is more than five days which does not correspond to the case of last seen. Post mortem was done on 30.07.2019 whereas it is alleged that the deceased was last seen on 28.07.2019. In addition thereto, other accused persons,who were named in the FIR, have been granted bail regular bail by coordinate Benches of this Court.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Danapur in connection with Sigori P.S. Case No. 70 of 2019.
