JUSTICE SUDHIR SINGH ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 324 and 302/34 of the Indian Penal Code, 27 of the Arms Act and 3/5 of the Explosive Substance Act. Allegation against the petitioner is to have fired shot at the informant causing injuries on his hand and left side of the chest.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 16.7.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is said to have caused a single fired shot upon the informant. Petitioner has been falsely implicated in the present case due to political reason. It is a case and counter case. Other co-accused in the present case has been acquitted by the trial court which is evident from Annexure-2. Informant has filed a compromise petition in the court below vide Annexure-3 to the

Patna High Court Cr.Misc. No.40671 of 2015 (3) dt.29-10-2015 2 / 2 present application. It is further submitted that petitioner may be released after completion of six months in custody from 16.7.2015.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody from 16.7.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Wazirganj P.S. Case no. 111/2006 corresponding to G.R. no. 1238/2006.
