JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Maranchi P.S. Case No. 89 of 2017, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Allegation is of committing theft in the house of the informant and nobody has been named in the FIR but later on one Lalu Pandey was arrested, who disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that there is no recovery from his possession and he has no criminal antecedent and similarly situated co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 18.12.2018 in Cr.Misc.No. 75073 of 2018. Heard learned APP also.

No.6547 of 2019(3) dt.02-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Barh, in connection with Maranchi P.S. Case No. 89 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
