2. The petitioner seeks bail in connection with G.B. Nagar P.S. Case No. 431 of 2023 registered for the offence under Sections 399, 402, 414 of the Indian Penal Code, under Sections 25(1-B), 26 and 35 of the Arms Act and under Section 8, 20(b)(ii)(B), 21(b) and 22 of the NDPS Act.

3. As per the prosecution case, one country made pistol and 8 gm of smack has been recovered from the petitioner.

4. The petitioner is in custody since 21.11.2023 and the petitioner claims that he has only one criminal antecedent bearing G.B. Nagar P.S. Case No. 390 of 2023.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Siwan/concerned Court below in connection with G.B. Nagar P.S. Case No. 431 of 2023.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Siwan Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As the petitioner claims that he have only one criminal antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other
