Mr.Sanjay Kumar Tiwary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-03-2025 Heard Mr. Bhavesh Kumar Sah, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar Tiwary, learned APP for the State.

2. The petitioners seeks pre-arrest bail in connection with Deodha P.S. Case No. 98 of 2024 registered for the offence(s) punishable under Sections 274, 275, 3(5) of the BNS and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the allegation made in the FIR, 540 litres of illicit liquor was recovered from four motorcycles and a Scorpio, which were parked in the Tent Godown of the petitioners.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.7614 of 2025(2) dt.06-03-2025 2/2 petitioners submitted that petitioners are innocent and have falsely been implicated in the present case.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and submitted that petitioner no.1 has one criminal antecedent under Excise Act and petitioner no.2 is the owner of one of the seized motorcycles.

6. Considering the huge recovery of illicit liquor, I am not inclined to grant pre-arrest bail to the petitioners. Accordingly, the present bail application stands dismissed. (Purnendu Singh, J) Sanjay/- U T
