ANJANA MISHRA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.6.2014 in connection with Araria P.S. Case No.276 of 2014 registered for the offences under Sections 363 and 366A/34 of the Indian Penal Code.

Earlier report had been called for from the court below, which has since been received. It appears from the report sent by the court of 1st Additional Sessions Judge-Cum-Special Judge, Araria that though charge has been framed against this petitioner on 2.1.2015, out of eleven prosecution witnesses, only one has been examined till date and hence the trial is likely to take some time.

No.40449 of 2015 (3) dt.30-09-2015 2/2 Considering the fact that the petitioner has been in custody since 20.6.2014 and the trial is at its nascent stage, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.276 of 2014.

It is made clear that the petitioner shall appear in the trial on each date and if he absents himself from the trial on two consecutive dates, it shall be the liberty of the court below to take appropriate action against the petitioner, including cancellation of his bail.
