JUSTICE SUDHIR SINGH ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 376 of the Indian Penal Code.
Allegation against petitioner is to have committed rape upon daughter of the informant.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 3.5.2013. Chargesheet has been submitted in the present case. The medical examination reports do not support the prosecution case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
A report was called for from the trial court regarding the stage of the case vide order dated 10.9.2015, same is at flag 'A' of the petition. From perusal of the report it would appear that one prosecution witness, out of six prosecution witnesses, has already been examined. The trial court expects that trial will be concluded preferably within a period of one and half months.
