The petitioner is in custody since 3.3.2014 in connection with Jhajha P.S. Case No.30 of 2014 registered for the offences under Sections 329, 420, 406 and 120B of the Indian Penal Code. It is submitted on behalf of the petitioner that the F.I.R. in the present case has been lodged against unknown person. It is alleged that one Saurav Singh came to the house of the complainant/informant stating that there was a vacany of Legal Adviser in Nokia Company. The informant believing on his statement, accompanied the said Saurav Singh to the Station and while he was trying to get the ticket, he handed over his bag containing Rs.25,000/- and all his original testimonials to the said

Patna High Court Cr.Misc. No.28193 of 2014 (5) dt.02-03-2015 2/2 Saurav Singh, who fled away with the same.

It is submitted that the petitioner is not said Saurav Singh nor he is the owner of Mobile No.9858153159 from which the informant has received phone call for coming and making application for the said vacancy. It is submitted that the petitioner was arrested on mere suspicion and thereafter an extra-judicial confession was made before the police and on the basis of the same, he is languishing in jail for about one year. Considering the aforementioned submissions, the period of custody and also that the petitioner has clean antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Shyamal Kumar, learned Judicial Magistrate, 1st Class, Jamui, in connection with Jhajha P.S. Case No.30 of 2014.
