Petitioner seeks bail in a case registered for the offence punishable under Section 7(a) of the Prevention of Corruption Act, 1988 (Amended 2018).

The petitioner was trapped while accepting bribe for showing favour in release of pension to the complainant. Petitioner is in custody since 29.10.2020. Investigation of the case against the petitioner is already complete. Submission is that there is no material to substantiate that the petitioner is going to tamper with the evidence. Learned counsel for the Vigilance vehemently opposed the prayer for bail.

Considering the period already undergone by the petitioner and completion of investigation, coupled with the fact

No.17660 of 2021(3) dt.25-10-2021 2/2 that nothing is there to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released, after framing of the charges, on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Vigilance Police Station Case No. 23 of 2020, Special Case No. 21 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
