The petitioner has field this writ petition for quashing the order dated 15.03.2017, as contained in memo No. 404, issued under the signature of District Magistrate, Nalanda whereby the petitioner has been put under suspension for defalcation of Rs. 72,14,500/- in the financial year 2013-14 and 2014-15.
The learned counsel for the petitioner submits that the petitioner is not being paid subsistence allowance during the period of suspension and the petitioner has already filed representation before the Additional Collector for payment of
Patna High Court CWJC No.11917 of 2017 (2) dt.07-09-2017 2/2 subsistence allowance.
Having considered the submission of the parties and on perusal of the records, I find no illegality in the order of suspension. This writ petition is, accordingly, dismissed. However the Additional Collector, Nalanda, respondent No.4, is directed to pay subsistence allowance to the petitioner during the period of suspension.
