The petitioner is languishing in jail since 19.12.2014 in a case instituted under Sections 364 and 120(B) of the Indian Penal Code.
As per allegation, it is a case of abduction of informant's son, namely, Kabindra Rai with an intention to kill by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.12.2014. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. Patna High Court Cr.Misc. No.39650 of 2015 (3) dt.12-10-2015 named in the FIR merely on the basis of suspicion as she happens to be the Mausi of the wife of the deceased. There is no substantive piece of evidence to suggest her implication in the present case.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned SDJM, Sikrahana, East Champaran at Motihari in connection with Rajepur P.S.Case No.129 of 2014.
