JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 19.03.2015 in connection with Chakiya P.S. Case No. 327 of 2013 for the offences instituted under Sections 376 of the IPC and 3(1)(ix) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that the petitioner committed rape upon the informant in the sugarcane field.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 19.03.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence

Patna High Court Cr.Misc. No.40787 of 2015 (3) dt.14-10-2015 2/2 against the petitioner. The petitioner has falsely been implicated in the present case. From perusal of Annexure-2 to the present application it is apparent that the matter has been settled between the paries.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari, in connection with Chakiya P.S. Case No. 327 of 2013.
