2. In the present case, the petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 316 of 2025 dated 24.10.2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(3), 115(2), 117(2), 118(2), 109(1), 132, 121(1), 121(2), 125(a), 125(b), 221, 192, 61(2), 263 and 324(4) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, the police went to verify the news about the selling of illicit liquor. The co-accused Rohit Kumar was apprehended, but a crowd assembled and entered into a scuffle with the police party at the instigation of mother of the co-accused Rohit Kumar. Two ladies from the crowd freed the co-accused. Thereafter, when they were being brought to the police station, they gave a general call for opposing the police
Patna High Court CR. MISC. No.6677 of 2026(2) dt.04-02-2026 2/3 team and a number of persons assembled and attacked the police party causing a number of injuries to the police personnel. The petitioner is said to be the person who was leading the mob.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in the present case and he is a journalist. The petitioner went to spot after getting information about the scuffle between police and village people and was video-graphing the occurrence which was interrupted by the police personnel and as the petitioner did not stop shooting the occurrence, he was arrested by the police. No specific allegation has been made against the petitioner and no specific overt act has been attributed to this petitioner. Altogether, 17 persons have been named in the FIR and 20 to 25 unknown persons have also been made accused in this case. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 25.10.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the non-specific nature of allegation against the petitioner for any overt act of assault and also considering his period of custody and

No.6677 of 2026(2) dt.04-02-2026 3/3 submission of chargesheet, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai / concerned Court, in connection with Bhagwanpur P.S. Case No. 316 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Arun Kumar Jha, J) Shahnawaz/- U T
