For the Opposite Party : Mr. M.K.Nirala(App) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 14-01-2015 A criminal case, for the crime, punishable under Sections- 498A and 304B of I.P.C. was registered against the petitioner. He was arrested on 28.5.2014and thereafter he moved B.P. No.280/14 in the Court of 1st Additional Sessions Judge, Banka. That was rejected on 26.8.2014. Hence, this application.

Heard Shri Sanjay Kumar Jha, learned counsel for the petitioner, and Shri M.K. Nirala, A.P.P., for the State.

It is brought to the notice of the Court that though an allegation was made referable under Section304B of I.P.C., after investigation it was modified to the one under Section-306 of I.P.C. Now that the charge-sheet is filed, it is not necessary to retain the petitioner in prison. The application is allowed.

Patna High Court Cr.Misc.
