The petitioner is in custody in a case registered under Sections 341, 323, 448, 504, 506, 327, 307, 34 of the Indian Penal Code.
It is alleged by the informant that while he was working in his shop, in the meantime petitioner and other co-accused persons came and started to abuse of caste line and on protest the accused persons entered into the shop and started to assault him and the petitioner attempted with knife on his head. It is further alleged that cause of incident is that his brother Pappu had abducted one girl for which mother of the petitioner lodged a case. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.39575 of 2015 (3) dt.12-10-2015 2/2 petitioner has got no criminal antecedent. He is in custody since 28.6.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. It is a case and counter case between the parties. It is also submitted that the petitioner has been falsely implicated in the present case.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj in Bahadurganj P.S.Case No. 120 of 2015.
