JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioenr is said to have given spade blow on the back portion of the head of the informant's brother whereas co-accused Jitendra Rai gave Farsa blow causing head injury to the informant's brother. The informant's brother sustained two sharp cutting injury and out of the aforesaid injury one injury is said to be simple in nature whereas another injury is said to be grievous in nature. Admittedly, the alleged occurrence took place on account of land dispute. Petitioner is in jail custody since 18.062014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.38456 of 2014 (3) dt.10-02-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Garakha P.S.Case No. 78 of 2013.
