The petitioners seek bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named the petitioner along with others accused persons and made general and omnibus allegation of assault. The informant made specific allegation against Ashok Mistri that he assaulted his father with iron rod on his head due to which he died on the spot. When the informant and his cousin Sunil Mistry went to save him, Ashok Mistri also assaulted them.

Patna High Court Cr.Misc. No.40182 of 2015 (2) dt.01-09-2015 2/2 No specific allegation of assault has been made against the petitioners.

It is submitted that the deceased got one injury on his head which is attributed to Ashok Mistri.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, District- Patna in connection with Bihta P.
