This application has been filed for cancellation of anticipatory bail which was granted to the petitioner, Nanda Ray vide order dated 29.02.2016 passed in Criminal Miscellaneous No.43240 of 2015. However, condition was imposed that in view of the criminal antecedent, he would be required to appear before the Superintendent of Police, Vaishali at Hajipur within fifteen days of the release with a copy of the order and every two weeks thereafter for the next six months. During that period, the conduct of the petitioner was required to be kept under watch by the Superintendent of Police with a further condition that if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail.

No.33583 of 2016 (2) dt.17-08-2016 2 / 2 Learned counsel submits that the petitioner, Nanda Ray never appeared before the Superintendent of Police and, thus, his bail bond should be cancelled. It is also submitted that the petitioner, after his involvement in that case, has again been involved in another criminal case bearing Ekangarsharai P.S. Case No.15 of 2016.
However, in my view, such report should have been submitted by the Superintendent of Police before the court below itself giving direction to initiate a proceeding for cancellation of bail bond for misuse of bail.
Accordingly, this application stands disposed of with a liberty to the State to approach the court below for such purpose which shall examine the matter and pass order and take appropriate steps in accordance with law.
