Petitioner is in jail custody since 11.11.2014 in a case registered under sections 376 and 313 of the Indian Penal Code. It would appear from perusal of the first information report that petitioner had been establishing his physical relation with the informant since last five years and on several occasion, allegedly, he got aborted pregnancy of the informant but the first information report as well as statement of the victim recorded under section 164 of the Cr.P.C reflect that the informant appeared to be consenting party. Informant also appeared to be major at the time of alleged occurrence. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Motihari in Sessions trial no. 203/2015 arising out of Darpa P.S. Case no.
