Patna High Court C.Misc. No.299 of 2018(14) dt.11-07-2023 2/2 Additional District Judge-12th, Muzaffarpur in Title Appeal No. 41 of 2016 under which the petition dated 16.06.2017 of the appellants-petitioners filed under Order 41 Rule 27 CPC has been rejected.
Learned counsel for the petitioners submits that the Title Appeal No. 41 of 2016 has already been dismissed for default accordingly Civil Miscellaneous Application has become infructuous. He further submits that this Civil Miscellaneous Application may be disposed of with liberty to the petitioners to file appropriate petition, if so required, in accordance with law, on restoration of said Title Appeal.
In view of the submission on behalf of the petitioners, this Civil Miscellaneous Application is disposed of with liberty to the petitioners as prayed for.
