The petitioners are in custody in a case registered under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.

The allegation against the petitioners is of killing the brother of the informant. His brother was doing the business of money lending on interest and in that course he had given Matendra Singh Rs. 3 lacs, Pankaj Singh @ Guddu Singh Rs. one lac and fifty thousand and Hari Mohan Singh Rs. 45 thousand. There was difference between them because of money transaction.

They have no criminal antecedent. There is no allegation of tampering with the evidence against the petitioners. The petitioners have been named in the present case merely on the basis of last seen. Except for suspicion, there is no other evidence to suggest the implication of the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the facts aforesaid, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Arbind Kumar, learned J.M., Chapra, District- Saran in Kopa P.S.Case No. 37 of 2015.
