The petitioner seeks bail in connection with Sessions Trial No. 362 of 2018 arising out of Bettiah Muffasil P. S. Case No. 213 of 2016 dated 22.05.2016 instituted for the offences under Sections 323, 307, 386 and 34 of the Indian Penal Code.

The petitioner is stated to be in custody since 01.06.2017.

For the reason that the petitioner is also an accused in a case instituted under the Narcotic Drugs and

Patna High Court CR. MISC. No.4918 of 2020(4) dt.07-07-2020 2/2 Psychotropic Substances Act, 1985, in which he has not been granted bail, this Court asked for a report from the court below about the stage of this case.

The report has since been received and kept at flag-C.

It appears from the report that the trial has not yet started and the case is pending for the appearance of two other accused persons of this case.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, West Champaran, Bettiah in connection with Sessions Trial No. 362 of 2018 arising out of Bettiah Muffasil P. S. Case No. 213 of 2016.

The petition stands allowed.
