JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be in jail custody since 29.06.2014 in a case in which cognizance of the offences punishable under section 498A, 379, 323 and 313 of the Indian Penal Code has been taken.

The contention on behalf of the petitioner is that the informant is not legally wedded wife of the petitioner and as a matter of fact, she is wife of another person from whom she gave birth to eight children.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.40678 of 2015 (2) dt.10-09-2015 2/2 two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge cum Special Judge, Saran at Chapra in connection with session trial no. 309 of 2015 arising out of Taraiya P.S.Case No. 28 of 2013.
