JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This application, for grant of anticipatory bail, arises out of Kateya P.S. Case No. 336 of 2018, disclosing offences under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and others causing injuries to them. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and further there is case and counter case and the title suit is also going on between the parties.
Heard learned A.P.P. also.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.8576 of 2019(2) dt.13-02-2019 2/2 from perusal of the impugned order it appears that petitioner was directed to surrender in the court below within a period of four weeks to seek regular bail and the learned court below on being satisfied with the undertaking on affidavit that petitioners will maintain peace and tranquility between them and they will not involve in criminal activity and co-operative in expeditious disposal of the case, was directed to consider the regular bail of the petitioner.
In such view of the matter, I find no reason to interfere with the impugned order of Sessions Judge, Gopalganj rather the petitioner was directed to surrender before the court below and pray for regular bail and if any such application is filed, the court below shall consider the same in terms of the order dated 19.12.2018 passed by learned Sessions Judge, Gopalganjg.
With the above observation and direction, this application is disposed of.
