JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Patahi P.S. Case No. 312 of 2019 for the offence under Sections 147,148, 149, 341, 323, 324, 326, 325, 307, 353, 332, 333, 379 and 120B of the Indian Penal Code.

Allegation against the petitioners is that they along with 200-250 male and female, armed with Lathi, Danda, Farsa, rod etc., have attacked the police force when police arrested Sushila Devi on the ground that 9.5 litres of country made liquor was recovered from her house.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 14.11.2019.

No.5556 of 2020(2) dt.31-01-2020 2/2 Considering the fact that the petitioners have got no criminal antecedent and they were among the mob of 200-250 persons, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with Patahi P.S. Case No. 312 of 2019.
