ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Surajpura P.S. Case No. 48 of 2016 registered for the offence under Sections 147, 148, 149, 341, 323, 504, 307 and 379 of Indian Penal Code as well as Section 27 of the Arms Act. Learned counsel for the petitioners submits that there is case and counter case between the parties and injuries are said to have been inflicted on both sides. It is further submitted that the allegation for offence under Section 379 of Indian Penal Code appears to be superficial and is added only to make the charge graver.

Having regard to the facts and circumstances of the case

Patna High Court Cr.Misc. No.33364 of 2016 (3) dt.15-09-2016 and taking into consideration the injury report which has been brought on record by way of filing a supplementary affidavit, let the above named petitioners in the event of their arrest/surrender within a period of four weeks from the date of receipt of copy of order shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sasaram, in connection with Surajpura P.S. Case No. 48 of 2016, subject to condition as laid down under Section 438 (2) of Cr.P.C.
