The petitioners are apprehending arrest in a case registered for the offences punishable under sections 414/34 of the Indian Penal Code.
The prosecution case is that on information that a stolen pick-up van along with trailer are lying in the backyard of the co-accused Santu Sahni, a raid was laid when co-accused Santu Sahni was arrested and on his confession tractor was recovered from Rajeshwar Singh, who suggested the name of co-accused Sunil Singh, Pitambar Pandey and Vikash Giri, who brought the stolen vehicle to the house of co-accused Santu Sahni. It is alleged that petitioner actually got the vehicle stolen and on his instruction the vehicle was kept at the place of

It is submitted by learned counsel for the petitioner that even assuming the accusation the seizure has not been made from the possession of the petitioner hence no offence under section 414 IPC is made out against the petitioner. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Dumrighat P.S. Case No.58 of 2015, pending before the learned CJM, East Champaran, Motihari. With the above observation, this application is, accordingly, disposed off.
