JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to the prosecution case itself, the relation of deceased was not cordial with the petitioner and she was residing at her parental home. Furthermore, it is an admitted case of the prosecution that deceased along with her child left her parental home on 25.12.2013 and subsequently, on 07.01.2014 a skeleton was recovered in the field of Sugar Cane and furthermore, child of the deceased was recovered in an abandoned condition in village Harpur on 26.12.2013 but even after recovery of child in an abandoned condition, the informant did not lodge the case and subsequently, after recovery of skeleton, the informant lodged the

Patna High Court Cr.Misc. No.40430 of 2015 (4) dt.10-11-2015 2/2 present case but there is nothing in the entire case diary to show that the deceased was taken away by the petitioner from her parental home.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Nautan P.S.Case No. 10 of 2014.
