JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Balia P.S. Case No. 250 of 2018, disclosing offences under Sections 401, 413, 414/411 of the Indian Penal Code and Sections 25(1-b)A, 26 of the Arms Act. Allegation as per F.I.R. is that police on information raided the place of occurrence and arrested one person and recovered 9 live cartridges from him and he also disclosed the name of the petitioner. Further, it appears that there is also recovery of one television from the house of the petitioner. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and though one television has been recovered from the house of the petitioner, but that has not been put on T.I.P. Heard learned A.P.P. also.

No.10917 of 2019(2) dt.22-02-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible, to be disposed of on the same day.
Accordingly, this application is dismissed.
