2. The petitioner seeks bail in connection with Gaighat P.S. Case No. 377 of 2023 registered for the offence under Section 8, 17(c) and 18(c) of the NDPS Act.

3. As per the prosecution case, 29.650 kilograms of Posta Husk and 34 grams of opium has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner is merely the driver of the vehicle.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 24.09.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the recovery of intermittent quantity, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 11, Muzaffarpur in connection with Gaighat P.S. Case No. 377 of 2023. (Sandeep Kumar, J) Vikas/- U T
