JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 Petitioner seeks bail in anticipation of her arrest in connection with Shambhuganj P.S. Case No. 147 of 2018, registered for the offences punishable under Sections 406, 409, 420 and 120B of the Indian Penal Code.

Allegation against the petitioner, who happens to be Mukhiya of Gulni Kushaha Gram Panchayat, is of defalcation of Rs.25,96,171/- allotted for the purpose of construction of drain under Mukhya Mantri Saat Nischay Scheme.

Submission of learned counsel for the petitioner is that without looking into the real and correct position the case has been lodged against the petitioner, rather the work has already been completed as per the measurement book of Junior Engineer.

No.7258 of 2019(4) dt.29-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender the petitioner shall be released on provisional bail till submission of charge sheet by the court below on the condition that she will co-operate in the investigation and produce all the papers before the Investigating Officer, who will inquire into the matter. However, even after the investigation the case is found true and charge sheet has been submitted against the petitioner, the petitioner has to surrender before the court below and pray for regular bail, which shall be considered on the basis of the materials available on record at that time.

With the above observation, this application is disposed of.
