JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Petitioner is languishing in custody since 26.10.2013 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

It is specifically alleged that ten years old daughter of the petitioner was shot dead by Ram Babu Sah when it is alleged that this petitioner was accomplish of Ram Babu Sah. During investigation it transpired that mobile of the petitioner and Ram Babu Sah were operational under same mobile tower and petitioner talked with Ram Babu Sah twenty seven times on the alleged date of occurrence. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

Considering the fact that specific accusation of causing fire arm injury is against Ram Babu Sah, let the

No.23864 of 2014 (3) dt.05-01-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge, Madhubani in connection with Andhra Math P.S. Case No. 55 of 2013.

Learned Court below will cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.
