The petitioners seek regular bail in connection with Karpi (O.P. Saher Tirpa) P.S. Case No. 41 of 2014 for the offences punishable under Sections 147, 149, 341, 323, 324, 504 and 302 of
Patna High Court Cr.Misc. No.7012 of 2019(2) dt.08-02-2019 2/2 the Indian Penal Code.
The allegation is regarding the accused persons having assaulted the informant with lathi and danda causing injury to him and subsequently the informant is said to have died during the course of his treatment.
The learned counsel for the petitioners submits that initially the petitioners had been granted bail, however, their bail bonds were cancelled, after the charge sheet was filed by the police and Section 302 of the Indian Penal Code was added. It is further submitted that similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court by order dated 06.11.2018 passed in Cr. Misc. No. 67589 of 2018. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Arwal in connection with Karpi (O.P. Saher Tirpa) P.S. Case No. 41 of 2018.
