The petitioner is languishing in custody since 07.12.2018 in a case registered for the offences punishable under Sections 447, 147, 148, 149 and 504 of the IPC and Section 27 of the Arms Act.

The prosecution case, as per the written report of Kishori Yadav, dated 27.06.2017, submitted to the Station House Officer, Kotwali Police Station, is to the effect that certain people used to abuse and assault the informant since last 2-3 days. It is alleged that on 25.06.2017 at about 11 P.M., nine FIR

Patna High Court Cr.Misc. No.6639 of 2019(2) dt.07-02-2019 2/3 accused persons including the petitioner abused the informant and on 26.06.2017, at about 9.30 P.M., all the accused persons including the petitioner resorted to fire and hurled explosives on the son of the informant, though the son of the informant did not receive any injury.

It is submitted by learned counsel for the petitioner that in the background of litigated relationship between the parties, the accusation has been levelled against the petitioner. For the occurrence of 26.07.2017 at about 9.30 P.M., FIR was lodged on 27.06.2017 at 1.30 P.M. It is further submitted that similarly situated co-accused persons have been granted bail by differenct Benches of this Court, vide Cr. Misc. Nos. 11944, 42068, 40469, 50904 and 53271 of 2018.

Learned APP submits that the petitioner is named in the FIR.

Considering the fact that informant's side has not received any injury, the accusation against the petitioner being omnibus and general and similarly situated co-accused persons have been granted bail by different Benches of this Court, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Gaya in
