JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 20 of the NDPS Act. Prosecution case is that 300 grams Ganja has been recovered from the cow dung house (goitha house) of the petitioner.

Learned counsel appearing for the petitioner submits that the no incriminating material has been recovered from the conscious possession of the petitioner. Dung house in question does not belong to the petitioner who is 85 years old. Petitioner has got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.7114 of 2023(2) dt.17-04-2023 2/2 each to the satisfaction of the Sessions Judge cum Special Judge Madhepura in Gamhariya Police Station 164 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
