JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner apprehends his arrest in connection with Halsi P.S.Case No. 163 of 2018 registered under Sections 307,387,504 and 506 of the Indian penal Code. Allegation against the petitioner is of firing causing injury on the leg of the informant.

Submission of learned counsel for the petitioner is that there is case and counter case in between the parties and it appears improbable that petitioner would have been identified by the informant during firing from the back side. Heard learned APP and learned counsel for the informant who have opposed the prayer for anticipatory bail stating that there is clear cut allegation against the petitioner of firing and injury is on the leg.

Having heard both sides and in view of the facts and

Patna High Court CR. MISC. No.6832 of 2019(3) dt.04-04-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
