JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the informant and is languishing in jail custody since 22.07.2015 in a case registered under section 323, 498A, 406 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

No doubt, earlier petitioner agreed before the Bench of this Court to negotiate the matter with the informant and taking note of the aforesaid fact, the co-ordinate Bench of this Court granted provisional bail to the petitioner but submission on behalf of the informant is that petitioner did not take any steps to reconcile the dispute.

No.41153 of 2015 (2) dt.11-09-2015 2/2 It would appear from the impugned order, first information report as well as submissions of the parties that the petitioner has already filed divorce suit against the informant whereas informant has filed maintenance case against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Mahila P.S.Case No. 51 of 2014.
