The petitioner seeks bail in a case under Section 271, 272 of the Indian Penal Code, section 47(a) of the Excise Act and under section 25 (1) (D), (1-Appellate Authority ), 26(iii) and 35 of Arms Act.

The house of the petitioner was raided but one person was found stacking some articles in a sack. The persons disclosed his name as Tunnu Yadav. From the sack one country made pistol of 312 bore, many articles for making arms and 37 pouches each containing 200 ml. country made liquor were recovered. Nothing has been recovered from the possession of the petitioner. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.38976 of 2015 (2) dt.28-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar Tripathi, learned Judicial Magistrate, 1st class, Bikramganj, Rohtas in Natwar P.S. Case No. 55/2014.
