The petitioner seeks bail in K. Nagar P.S. Case no. 654/2014, registered for the offences punishable under Sections 341, 326, 302, 34 of the Indian Penal Code.

The petitioner is said to have entered into the house of the informant along with Anant Mahto @ Gandu Mahto and Raj Kumar Mahto. The petitioner and Raj Kumar Mahto were armed with country made pistol. Anant Mahto @ Gandu Mahto was armed with dagger. The petitioner is alleged to have pointed the pistol and Anant Mahto stabbed the wife of the informant on her chest causing her death during course of treatment. No allegation of assault is made against the petitioner and the petitioner is in jail since 11.02.2015.

Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.38913 of 2015 (2) dt.04-09-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Magistrate, Purnea in connection with K. Nagar P.S. Case no. 654/2014.
