====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nima Chandpura P.S. Case No. 75 of 2018, instituted for the offence under Section(s) 30(A) of Bihar Prohibition & Excise Act. It is alleged in the written report that 1092 bottles of foreign liquor has been recovered from a trailer of a tractor hidden inside the sand. Police arrested the driver of the tractor who disclosed his name as Avinash Kumar. It is further alleged that two persons were found moving on the Motorcycle. The driver of the Motorcycle fled away, but person who was sitting on the Motorcycle, was apprehended by the police. He disclosed his name as Ajit Kumar (petitioner). Counsel for the petitioner submits that there is no

Patna High Court Cr.Misc. No.9149 of 2019(2) dt.18-02-2019 2/2 recovery of foreign liquor from possession of the petitioner. Petitioner is in custody since 9.8.2018 having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum Special Judge Excise, Begusarai, in connection with Nima Chandpura P.S. Case No. 75 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
