Let the defects be removed within four weeks after start of the physical Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Sixteen grams of Smack in different small packets was allegedly recovered from possession of the petitioner. Submission is that the petitioner has got no criminal antecedent. He is in custody since 07.09.2020. Investigation of the case against the petitioner is already complete. The recovered quantity was more than small quantity and less than commercial quantity.

Considering the material on the record, it cannot be assumed that the petitioner would repeat the offence in future

No.17706 of 2021(2) dt.06-08-2021 2/2 or was involved in business of narcotic drugs, hence, let the petitioner, above named, be released on bail, after framing of the charges so that trial may not hamper, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 136 of 2020 arising out of Alamganj Police Station Case No. 525 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
