JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 The petitioner apprehends his arrest in connection with Bairgania P.S.Case No. 336 of 2017 registered under Sections 323, 406, 420 and 504 of the Indian penal Code. Allegation, as per the FIR, is that informant had taken Saries from the shop of the petitioner and he gave cheque to the petitioner on assurance to deposit the same after some time so that informant may deposit sufficient amount in his account. It is alleged that cheque of Rs. 1,50,000/- presented before the bank but the same were bounced. Thereafter, petitioner assaulted the informant.

Submission of learned counsel for the petitioner is that this is a case of dispute in business transaction and there will be civil liability for that.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Bairgania P.S. Case No. 336 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
