1. Heard learned Sr. counsel Mr. Krishna Prasad Singh appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner is named in F.I.R. and apprehending his arrest in connection with Bikramganj P.S. Case No. 548 of 2023, registered for the offences punishable under Sections 307, 323, 341, 342, 332, 353, 427, 448/34 of the Indian Penal Code.

3. The allegation against petitioner is to assault informant, who is Executive Assistant of Indira Awas Yojna and also to torn documents related with the project, for the reason that the name of certain local persons were not added with Pradhan Mantri Awas Yojna.

Learned Sr. counsel Mr. Krishna Prasad Singh appearing on behalf of the petitioner submitted that the petitioner in fact being husband of Deputy Mukhiya, was assisting people for registering with scheme. It is submitted that out of said reason, petitioner implicated with present case. Learned Sr. counsel submitted fairly that injury in issue is not grievous in nature, where allegation of assault is appearing very much general and omnibus. It is further pointed out that even the allegation to torn government papers and to deter informant to discharging official functions is also not appearing specific against petitioner rather same is also appearing very much general and omnibus. It is submitted that petitioner is a man of clean antecedent.

5. Learned APP opposes the prayer of bail.

Considering the aforesaid facts and circumstances and by taking nature of allegation qua assault and also to deter informant to discharge official functions is appearing very much general and omnibus, coupled with the fact that petitioner is a man of clean antecedent, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees

Case No. 548 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
