Petitioner seeks bail in a case registered for the offences punishable under sections 302, 120-B/34 of the Indian Penal Code and section 27 of the Arms Act.

Prayer for bail of the petitioner was rejected earlier by order dated 30.01.2015 vide Criminal Misc. No. 29844 of 2014. The trial court was directed to expedite the trial and conclude the same within one year from the date of receipt/production of this order.

It is submitted that most of the witnesses have already been examined and the case is pending only for examination of the doctor and I.O. One year has not elapsed from the date of the order.

Patna High Court Cr.Misc. No.41943 of 2015 (2) dt.23-09-2015 Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Musrigharari P.S. Case No. 139 of 2013 corresponding to Sessions Trial No. 33 of 2014 pending in the court of learned 5th Additional Sessions Judge, Samastipur. His prayer for bail is, accordingly, rejected again.
